Terms of Service

These Terms of Service (“Terms”) are an agreement between you and DoWhat (“DoWhat,” “we,” “us”) governing your access to and use of our salon management software, websites, and mobile apps (together, the “Services”). By creating an account or using the Services, you agree to these Terms. If you’re agreeing on behalf of a business, you represent that you’re authorized to bind that business.
1. Accounts & eligibility
The Services are for business use by salons and their staff. You must be at least the age of majority in your jurisdiction. You’re responsible for the accuracy of your account information, for all activity under your account, and for keeping your credentials secure. Notify us promptly of any unauthorized use.
2. The service & license
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to access and use the Services for your salon’s internal business operations. We may update, improve, or change the Services over time.
3. Subscriptions, billing & renewals
- Paid plans are billed in advance on a recurring basis and renew automatically until cancelled. You can cancel anytime; access continues through the end of the current paid period.
- Fees are exclusive of taxes, which you’re responsible for. We may change prices with reasonable prior notice, effective at your next renewal.
- Except where required by law, payments are non-refundable. Purchases made through a third-party app store are also subject to that store’s terms and billing, and refunds for those purchases are handled by the store.
4. Your data & responsibilities
You retain ownership of the data you and your staff enter (“Customer Data”), including information about your own clients. You are responsible for your Customer Data and for having the necessary rights and consents to collect and use it, including any notice or consent required from your clients. You agree not to use the Services in violation of applicable law. Our handling of personal information is described in our Privacy Policy.
5. Acceptable use
You agree not to:
- use the Services unlawfully or to store or transmit unlawful or infringing content;
- attempt to gain unauthorized access to the Services or other accounts;
- interfere with or disrupt the integrity or performance of the Services;
- reverse-engineer or resell the Services except as permitted by law.
6. Intellectual property
We and our licensors own the Services and all related intellectual property. These Terms don’t grant you any rights except the limited license above. Feedback you share may be used by us without obligation to you.
7. Third-party services
The Services may integrate with third-party products (e.g. payments, messaging, calendars). Your use of those is subject to their terms, and we’re not responsible for third-party services.
8. Disclaimers
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the Services will be uninterrupted or error-free.
9. Limitation of liability
To the fullest extent permitted by law, DoWhat will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim arising out of the Services is limited to the amount you paid us for the Services in the twelve months before the claim.
10. Indemnification
You agree to indemnify and hold DoWhat harmless from claims arising out of your Customer Data, your use of the Services, or your breach of these Terms, to the extent permitted by law.
11. Term & termination
You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms or to protect the Services or other users. On termination, your right to use the Services ends; we’ll make Customer Data available for export for a limited period as described in our Privacy Policy, after which it may be deleted.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above and, where appropriate, additional notice. Continued use after changes take effect means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. Disputes will be subject to the courts located in Ontario, Canada, unless applicable law requires otherwise.
